A senior lecturer at the University of Education, Winneba (UEW) is asking the High Court in Winneba to place an injunction on Friday’s election of the school’s Pro-Vice Chancellor. Dr. Frimpong Kaakyire Duku who is also the President of University Teachers Association of Ghana, UEW branch, in an affidavit in support of his suit want a declaration that the purported nomination of certain individuals to contest in the election of the Pro-Vice Chancellorship position “is illegal, null and void and of no legal effect”. The suit filed on 13th June 2019 by the solicitor for the applicant Alexander Afenyo-Markin would be moved in court on June 24. Dr. Duku prayed, “An injunction restraining the Respondent, its officers, agents or assigns from going ahead with the election of the Pro-Vice Chancellor under the guise of the said purported nomination on Friday, 14th June, 2019 or on any other date until the final determination of the suit.” According to the applicant, the Pro-Vice Chancellor position became vacant on February 2018 but a date for the election of a successor was only “circulated” on June 10 for an election scheduled for June 14. He noted that several qualified applicants were denied the opportunity to take up that position due to the way and manner the exercise is being conducted. “That the purported nomination clearly denies me and all other potential senior officers the opportunity to put ourselves up for election in as much as same is not in accord with the enabling Act as advised by my Counsel. “That again this purported nomination is discriminatory as the Respondent has failed to allow qualified persons willing to participate to be given the opportunity to contest in the election,” he said in the affidavit. According to him, the University is acting against the spirit and letter of Section 14(1) of the University of Education Act 2004, ACT 672 and statute 7 of the University of Education, Winneba Statutes 2007. It is for this reason he is seeking a “an order of certiorari to quash the purported nomination of certain individuals to be the only candidates to contest for election as Pro-Vice Chancellor of the Respondent institution”.
